1. Who we are
ClipForge (the "Service") lets you generate short AI videos from text and images and pay for them with prepaid credits. It is operated under the name Kitepond Studio by an individual operator at Bảo An, Phan Rang, Khánh Hòa, Viet Nam ("we", "us"). Kitepond Studio is a trading name, not an incorporated company. Contact: kitepondstudio@proton.me.
These Terms, the Privacy Policy and the Refund & Credits Policy are our agreement with you. A Vietnamese version is at /vi/terms; if the two differ, the Vietnamese version prevails for users in Viet Nam.
2. Accepting and changing these Terms
You accept these Terms by ticking the box at sign-up. We record the version you accepted and when. We may update the Terms; for material changes we give at least 30 days' notice by email or in the Service. If you disagree, stop using the Service and delete your account. A change never applies to a job you already submitted.
3. Your account
- You must be 18 or older and able to enter a contract. If you sign up for an organisation, you confirm you can bind it.
- Give accurate information and verify your email. You cannot generate videos until your email is verified.
- Keep your password secret. You are responsible for activity on your account unless we failed to protect it. Tell us at kitepondstudio@proton.me if you suspect misuse.
- One person may not run several accounts to abuse free credits, limits or our controls.
4. The Service
The Service is a front end to third-party AI models (see section 11). Models, prices and options can change, jobs can fail, and results are probabilistic: output may be inaccurate, flawed, offensive or similar to existing works. We do not promise that an output is unique, free of third-party rights or fit for your purpose. Review it before you use or publish it. The credit cost of a job is shown before you submit it and is reserved when you submit.
5. Credits, payment and free credits
5.1 Credits. Credits are a prepaid right to use the Service. 1 credit is priced at about US$0.01. Packs are sold in VND at the prices on the Credits page (at the date of these Terms: Starter 500 credits for VND 130,000; Creator 2,000 credits for VND 520,000; Studio 5,000 credits for VND 1,300,000; custom top-ups from VND 50,000 to VND 5,000,000). The Credits page shows the price that applies to your purchase.
5.2 No cash value. Credits are not money, e-money or a deposit, earn no interest, cannot be transferred or exchanged for cash, and can only be used for the Service.
5.3 Expiry. Purchased credits expire 12 months after purchase. Each lot's expiry date is shown in your credit history; the lot that expires first is used first. Expired credits are not refundable except where the law requires.
5.4 Free signup credits. From time to time we may give a small number of free credits to new accounts (the amount, if any, is shown at sign-up). They are granted once, only after you verify your email, and expire 30 days after they are granted. They have no cash value, cannot be refunded or paid out in cash, and cannot be transferred. To stop repeat claims we limit them to one per person: we compare a one-way hash of your normalised email address (and of your sign-up IP address) with earlier claims, we do not grant them to disposable email domains, and we keep those hashes after account deletion for this purpose only (see the Privacy Policy). We may withdraw free credits obtained by abuse.
5.5 Payment. Payment is processed by payOS (VietQR / bank transfer). We receive the order amount, order code and payment status; we never see your bank login. Prices are in VND as shown at checkout; you bear your own bank's fees.
5.6 Invoices. We do not issue invoices automatically. For an invoice or receipt, email kitepondstudio@proton.me with your order code and the details you want on it (name, address, and tax code if you are a business). We will issue it as the law requires for our situation. Your bank's transfer confirmation is your proof of payment in the meantime.
5.7 Refunds. Failed jobs are refunded automatically in credits. There are no cash refunds except as the law requires or as the Refund & Credits Policy says. Price changes never affect a job already quoted or credits already in your balance.
6. Failed jobs
If a job fails, times out (currently after 15 minutes) or is refused by the provider's safety system, the reserved credits are returned automatically. Jobs blocked by our own checks are not charged. A completed video you simply dislike is not a failed job.
7. Your content
7.1 Inputs and Outputs. "Inputs" are your prompts and images; "Outputs" are the videos generated for you. You keep your rights in your Inputs and promise that you have all rights and consents needed (including from any identifiable person shown) for us to process them, including by sending them to our providers. We give you whatever rights we have in the Outputs and claim no ownership of them, but AI output may not be protected by copyright and may resemble other works, so we do not warrant that you will own an enforceable right in it.
7.2 Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, process, copy and adapt (for example to add the AI label) your Inputs and Outputs, only to run, secure, moderate and support the Service and to obey the law. We do not train our own models on them, do not advertise with them and do not publish them.
7.3 Our materials. The Service and its software, design and trademarks belong to us or our licensors. You get a limited, revocable, non-transferable right to use the Service under these Terms.
8. Acceptable use
You must not use the Service to create, request, store or share:
- Minors: any sexual or sexualised content of a person who is or appears to be under 18, or content that exploits or endangers children. We report suspected cases to the authorities.
- Real people: deepfakes or realistic depictions of a real, identifiable person's face, body or voice without their clear, informed consent; impersonation of a person, official, organisation or brand; non-consensual intimate imagery; content that violates someone's privacy, dignity or reputation.
- Deception: fraud, scams, phishing, fake news or content meant to mislead people and cause serious harm (including the uses prohibited by Article 7 of the Law on Artificial Intelligence No. 134/2025/QH15); presenting AI output as real footage of real events.
- Illegal or harmful content: anything prohibited by Vietnamese law (including content that opposes the State, incites violence or hatred, is pornographic or discloses state secrets); terrorism, graphic violence, harassment, threats, hate or discrimination.
- Others' rights: content that infringes copyright, trademarks, image rights or other rights.
- Misuse of the Service: bypassing safety filters, limits or credit accounting; removing or falsifying the AI label; scraping or reselling the Service; sharing credentials; chargeback fraud or stolen payment methods; malware.
We use automated checks (keyword filter and providers' safety systems) and review content that is reported or flagged. We may block a prompt, remove content, withhold credits tied to abusive jobs, suspend or end an account, keep evidence and report to the authorities, without notice where the breach is serious or the law requires.
9. AI labelling
Under the Law on Artificial Intelligence No. 134/2025/QH15 (Article 11) and Decree No. 142/2026/NĐ-CP, AI-generated video must be identifiable. We therefore add a machine-readable AI-generated marking to the file and a visible "AI-generated" label in the bottom-right corner; if a video cannot be labelled we do not deliver it and refund the credits. You must not remove, crop out, hide or falsify the label or metadata, and you must not present an Output as real footage. If an Output imitates a real person's appearance or voice or recreates real events, keep it clearly labelled wherever you publish it, and you must have that person's consent. Videos made with Google Veo also carry the provider's own invisible SynthID watermark. Do not rely on Outputs for legal, medical, financial or safety decisions.
10. Reports and takedown
Send reports of illegal content, infringement, AI incidents or abuse to kitepondstudio@proton.me with your contact details, the content (link or job ID), the legal basis and a statement that your information is accurate. We act promptly, normally within 3 working days, and may remove content first and assess afterwards where harm could be serious. If we remove your content you can send a counter-explanation to the same address. We comply with lawful requests of Vietnamese authorities.
11. Third-party providers and your privacy
To generate videos we send your Inputs to fal.ai (Features and Labels, Inc., United States) and the developers of the models it runs for us: MiniMax (China), Google (United States), Lightricks (Israel) and Alibaba (China). The current model list is shown in the Service and may change. Our infrastructure comes from Oracle Cloud (hosting, Singapore), Cloudflare R2 (file and backup storage) and Resend (email); payments go through payOS. These providers act under their own terms, and their servers are outside Viet Nam: see the Privacy Policy, which describes how we process personal data and the cross-border transfer you consent to at sign-up. You can withdraw consent at any time, which may end the Service for you.
12. Ending the relationship
You may stop using the Service or delete your account at any time (unused credits are then forfeited, see the Refund & Credits Policy). We may suspend or end your account, with notice where practicable, if you materially breach these Terms, if the law or an authority requires it, or if your use threatens the Service. If we stop the Service or end your account without your fault, we refund unused paid credits.
13. Disclaimers and liability
The Service is provided "as is and as available". Nothing in these Terms limits your rights as a consumer under mandatory Vietnamese law, including the Law on Protection of Consumer Rights No. 19/2023/QH15, or any liability that cannot lawfully be excluded. Within what the law allows, we are not liable for indirect or consequential loss or lost profits, or for acts of third-party providers outside our reasonable control, and our total liability for a claim is limited to the greater of what you paid us in the 12 months before the event and VND 1,000,000. This limit does not apply to our intent or gross negligence or to death or personal injury. You are responsible for your Inputs and for how you use and publish Outputs, and will compensate us for loss and third-party claims caused by your breach of these Terms or of the law. Neither side is liable for failures caused by events beyond its reasonable control (for example disasters, power or network failure, or provider outages); credits for a job that could not be delivered are returned under section 6.
14. Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Viet Nam. Please contact kitepondstudio@proton.me first; we reply within 10 working days and try in good faith to resolve the issue by negotiation. If that fails within 30 days, the dispute is decided by the competent People's Court in Khánh Hòa Province, Viet Nam. As a consumer you keep your right to complain to the competent state agency, to ask a consumer organisation for help, and to go to the court you are entitled to.
15. General
If part of these Terms is invalid, the rest stays in force. Not enforcing a right is not a waiver. We may assign these Terms to a successor of the business with notice to you; you may not assign them without our consent.
